THE FOLLOWING CONTEST IS VALID ONLY IN CANADA (EXCLUDING QUEBEC) AND THE UNITED STATES (EXCLUDING PUERTO RICO, GUAM AND ALL OTHER U.S. FOREIGN TERRITORIES AND POSSESSIONS). TO BE ELIGIBLE FOR THIS CONTEST YOU MUST BE A LEGAL RESIDENT OF CANADA (EXCLUDING QUEBEC) OR UNITED STATES INCLUDING THE DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO, GUAM AND ALL OTHER U.S. FOREIGN TERRITORIES AND POSSESSIONS), CURRENTLY RESIDING IN CANADA (EXCLUDING QUEBEC) AND THE UNITED STATES (EXCLUDING PUERTO RICO, GUAM AND ALL OTHER U.S. FOREIGN TERRITORIES AND POSSESSIONS), AND THE AGE OF MAJORITY OR OLDER IN YOUR STATE, PROVINCE OR TERRITORY OF RESIDENCE, AS OF AUGUST 1, 2010. DO NOT ENTER THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF CANADA OR THE UNITED STATES. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN AND AMERICAN LAW. SUBMISSION OF AN ENTRY CONSTITUTES ACCEPTANCE OF ALL OF THE OFFICIAL RULES.
THE AGA GREAT ESCAPE CONTEST OFFICIAL RULES ("Official Rules")
NO PURCHASE NECESSARY TO ENTER OR WIN.
1. HOW TO ENTER:
The AGA Great Escape Contest (the "Contest") begins at 12:00:01 a.m. Eastern Standard Time ("EST") on August 1, 2010 and ends at 11:59:59 p.m. Eastern Standard Time ("EST") on October 31, 2010 (the "Contest Period"). All entries must be received by 11:59:59 p.m. EST on October 31, 2010. To enter for a chance to win visit www.aga-ranges.com (“the Contest Website”) and register for an AGA Cooker Demonstration online with all required information, including your name, email address, phone number, and postal code. Registrants will receive a voucher via automated email which must be given to the demonstrator at the AGA Cooker demonstration. AGA Cooker demonstrators are required to collect vouchers and mail original copies to AGA MARVEL c/o The AGA Great Escape Contest no later than 11:59:59 p.m. EST on November 15, 2010. Entries must include all the required information and must attend a full AGA Cooker demonstration to become eligible. Simply registering online does not qualify nor complete the contest requirements. Registering in person for AGA Cooker Demonstration does not qualify as a valid entry. Printed vouchers are required for the draw. AGA MARVEL (the “Sponsor”) and its agents are not responsible for any lost, late, misdirected, or incomplete entries or for any inaccurate transcription of entry information, or any failures and/or delays in on-line transmissions, malfunction or failure of any internet connection, malfunction or failure of software or hardware, or any other errors or delays in the transmission or receipt of entries, whether human or technical in nature. Proof of submission is not proof of receipt by Sponsor. Limit one (1) entry per person per AGA Cooker demonstration regardless of the email address of an entry up to a maximum of two (2) entries for contest period per person. All entries from any individual submitting or attempting to submit multiple entries are void. Use of mechanical assistance, form filling software or robotic assistance is prohibited. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
2. PRIZE:
There is one (1) prize available to be won consisting of a trip for two (2) people to North and South Carolina and Georgia, United States with an approximate value of Four Thousand US dollars ($4000.00). Prize must be redeemed between December 1, 2010 and June 30, 2011.
The Prize includes economy air transportation for two (2), departing from the nearest major US/Canadian Airport from the winner’s residence, to Charlotte Douglas International Airport in Charlotte, NC. Return economy flight from Savannah/Hilton Head International Airport in Savannah, GA to original airport of departure. Itinerary Day 1 includes Interactive AGA Cookery class and one (1) night accommodation at Duke Mansion Bed & Breakfast (www.dukemansion.com) Charlotte, NC. Day 2 includes AGA Cooker Home Tour and one (1) night accommodation at Planters Inn (www.plantersinn.com) in Charleston, SC. Day 3 includes AGA Cookery Class with a celebrity cookbook author and one (1) night accommodation at Palmetto Bluff Resort (www.palmettobluffresort.com)in Savannah, GA. Meals and ground transportation in Charlotte, Charleston and Savannah are included.
All other expenses not specified herein (including, but not limited to, transportation between the international/domestic airport and winner’s primary place of residence, some meals, telephone, fax or cable charges, personal services, insurance, incidentals or expenses or any other costs not specifically listed above as being included in the Prize package) are the responsibility of the Prize Winner and his/her guest. Transportation and accommodations subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations. Other restrictions may apply. Actual value of trip Prize is dependent on airline cost fluctuations. The Contest winner and his/her guest must travel together. Contest winner and his/her guest are responsible for all required medical and travel related necessities, including applicable insurance coverage's, and for obtaining all required travel documentation. All travel arrangements must be made through the Sponsor. Due to the nature of the Prize, no alternative travel dates are available. Except as otherwise indicated, the Sponsor makes no express or implied warranties of any kind, including no warranties with respect to safety, or performance of the Prize. Chances of winning are dependent upon the number of eligible entries received during the Contest Period.
Prize is not transferable. No substitutions or cash redemptions allowed. If the Prize notification is returned as undeliverable, or if the Contest winner cannot be contacted for any reason, or if a winner fails to execute and return required documentation within the time frame specified, Prize will be forfeited and awarded to an alternate eligible Contest entry. Prize will be delivered to Contest winner at the home address provided in the Contest entry.
3. SELECTION OF PRIZE WINNER:
Prize is not transferable. No substitutions or cash redemptions allowed. If the prize notification is returned as undeliverable, or if the winner cannot be contacted for any reason, or if a winner fails to execute and return required documentation within the time frame specified, prize will be forfeited and awarded to an alternate selected. Prize will be delivered to winner at the home address provided.
Potential Contest winner will be selected in a random drawing on or about November 21, 2010 at AGA MARVEL, Cambridge, Ontario, from all eligible entries submitted. The Sponsor’s selection of a winner and all decisions by Sponsor in respect of all matters relating to this Contest will be final and binding on all eligible Contest entrants.
The potential Prize winner will be notified by telephone and email, be required to confirm their status and availability to receive the Prize, correctly answer an arithmetical skill testing question, and will be required to sign and return an unmodified Declaration of Eligibility, Publication and Liability / Publicity Release within 7 days of issuance (the "Response Time"). If notification is returned as undeliverable, potential winner cannot be contacted or if potential winner fails to confirm their status and availability to receive the Prize or return all of the required documentation in the Response Time, or otherwise does not comply with these Official Rules, including correctly answering the skill-testing question, he/she will be disqualified in Sponsor's sole discretion and another winning entry shall be chosen by Sponsor. All Contest entrants hereby understand and agree that failure to respond to a Prize winner notification by Sponsor within the Response Time shall constitute a forfeiture of the Prize and Sponsor shall be entitled to award the Prize to another eligible entry. Non-winning entries and disqualified contestants will not receive the Prize or any other award or compensation, and the process described above will be repeated until a winner is declared. Chance of winning the Prize depends upon the total number of eligible entries received during the Contest Period.
4. ELIGIBILITY AND CONDITIONS:
The Contest is open only to legal residents of Canada (excluding Quebec) and the United States (excluding Puerto Rico, Guam and all other U.S. Foreign Territories and Possessions), who are the age of majority in their state/province/territory of residence as of August 1, 2010. Employees, representatives and agents of Sponsor and its parent companies, subsidiaries, affiliates, distributors, agents, advertising and promotion agencies involved with this Contest and those living in the same household of such persons and contest judges are not eligible to enter or win. This Contest is void in Quebec, Puerto Rico, Guam and all other U.S. Foreign Territories and Possessions and where prohibited by law. The entrant is the individual whose name appears on the entry form. Only one (1) entrant’s name may appear on the entry form. In the event of a dispute, if the name of the entrant on the entry form is not the same as the authorized account holder of the e-mail address at the time of entry, the entry will be deemed to be made by the authorized account holder. The "authorized account holder" is defined as the natural person (an individual) who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The Contest entry shall be void if the authorized account holder cannot be determined or the email address does not belong to a natural person.
5. GENERAL:
No correspondence regarding entries will be entered into with entrants, except as provided in these Official Rules. By entering the Contest, entrant agrees that Sponsor shall not be held responsible and that they have no right to bring (and covenants and agrees not to bring) any claim, action, or proceeding of any kind or nature whatsoever against Sponsor and its parent company, affiliated companies, subsidiaries, divisions, advertising and promotion agencies, and all of their respective agents, employees, directors, officers, shareholders, successors and assigns (collectively "Releasees") in connection with this Contest. By entering and/or accepting prizes, entrant agrees to be bound by these Official Rules and the Contest judge's decisions and to release all Releasees from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Contest or with the respect to awarding, receipt, possession, use and/or misuse of any Prize or participation in any prize-related activities.
As a condition of awarding the Prize, the winners of the Contest will be required to grant Sponsor the right to use the winner’s name, contact information (including, but not limited to, telephone number, address and email address as may be required by Sponsor for the purposes of this Contest) image and likeness, voice and comments for biographical materials, advertising, publicity and promotion without territorial, time or use limitations, including without limitation online announcements, without additional compensation, unless prohibited by law.
Sponsor reserves the right, in its absolute discretion, to modify, cancel, terminate, or suspend all or any part of this Contest at any time for any reason without prior notice. In such case, Sponsor may, in its absolute discretion, determine the winners in accordance with these rules from among all valid, non-suspect entries received prior to the event which warranted such action.
Sponsor reserves the right at its sole discretion, to disqualify any individual who (i) tampers with, or attempts to tamper with, the entry process; or (ii) violates any of these Official Rules.
6. INTERNET:
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor and/or their agents are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any damage to participant’s or any other person’s computer and other property relating to or resulting from participation in this Contest or from downloading any materials in this Contest.
CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
7. PRIVACY / PERSONAL INFORMATION.
By entering this Contest, each entrant consents to the collection, use, and disclosure, by Sponsor, of his or her personal information including name, contact information (including, but not limited to, telephone number, address, and e-mail address), and biographical information for (i) the administration of this Contest including, but not limited to, the announcement of winners and awarding and delivery of Prizes; and (ii) unless otherwise indicated by the entrant, for market and consumer research purposes. The name of the confirmed winners may be posted on the Contest website.
Except as otherwise specifically provided in these Official Rules, the decisions of the Sponsor will be final and binding on all entrants in respect of all matters relating to the contest. Prizes will be delivered to confirmed winners.
